Tiny houses in Texas

Texas has distinct pathways for site-built dwellings, HUD-code manufactured housing and vehicle-based units. Municipal zoning, county development authority, wastewater and private restrictions can all matter, so “Texas allows tiny houses” is not a parcel-level answer.

“Tiny house” is a lifestyle description. Regulators care about the legal building or vehicle classification.

Site-built / foundation dwelling

Municipalities have zoning authority under Local Government Code Chapter 211, while counties have more limited but still relevant development, subdivision and building-permit authority. Confirm the exact city, ETJ or unincorporated-county rules before assuming a small dwelling is permitted.

HUD-code manufactured home

Texas regulates manufactured housing through TDHCA and Occupations Code Chapter 1201. A new law taking effect September 1, 2026 will require municipalities with zoning to allow new HUD-code manufactured homes by right in at least one residential zoning classification or district, subject to statutory exceptions. That future change does not make every residential parcel eligible.

THOW / RV / park-model-type unit

Texas manufactured-housing law expressly distinguishes recreational vehicles from HUD-code manufactured homes. Vehicle registration, ANSI construction or mobility does not itself establish permanent residential occupancy on a particular lot; local land-use and park rules still need to be checked.

Rural site with septic

Texas generally requires an approved plan and permit for an onsite sewage facility, with limited exemptions. TCEQ says local authorized agents can impose requirements more stringent than the state minimums.

Before buying land or a home

  1. Is the parcel inside a municipality, its extraterritorial jurisdiction, or unincorporated county land?
  2. Will the unit be permitted as a site-built dwelling, HUD-code manufactured home, modular building, RV/THOW or park-model-type unit?
  3. What zoning district, subdivision rules, minimum lot size, setbacks, utility and flood requirements apply?
  4. If relying on the manufactured-home protections effective September 1, 2026, does the exact municipality and zoning district fall within the statute and its exceptions?
  5. Is public sewer available, or what OSSF/septic permitting authority and site evaluation apply?
